For the benefit of those impacted by a ransomware assault on the casino's computer network in 2022, the Eureka Casino in Mesquite, Nevada, has agreed to pay $1 million to resolve a class-action lawsuit.

The lawsuit identifies Rancho Mesquite Casino Inc., the operator of the Eureka, and claims that on November 9, 2022, the casino was the target of a "massive" cyberattack that lasted for several days.

According to the complaint filed in February 2023 in U.S. District Court for the District of Nevada, the breach led to the loss of personal information, including full names, Social Security numbers, and driver's license numbers belonging to 229,299 customers—possibly even workers.

 

Why is there a delay?

Plaintiffs claimed the company's cybersecurity safeguards were insufficient and that it neglected to promptly inform customers of the breach, accusing it of negligence and breach of contract.

About a month after the attack, on or around December 9, 2022, the casino alerted affected parties that their data had been compromised.

According to cybersecurity experts, victims of data theft should be informed as soon as possible so they may change their passwords, keep an eye on their financial accounts, and keep an eye out for any strange emails or credit activity, as these delays can be costly.

The lawsuit said that in addition to annoying spam calls, texts, and phishing emails, the breach exposed consumers to possible fraud both now and in the future.

“Simply put, plaintiff and class members now face [a] substantial risk of out-of-pocket fraud losses such as loans opened in their names, medical services billed in their names, tax return fraud, utility bills opened in their names, credit card fraud, and similar identity theft,” the complaint states.

Neither Rancho Mesquite Casino nor Eureka Casino acknowledged misconduct when they agreed to the settlement.

 

How Much Can Victims Make a Claim?

Class members are entitled to reimbursement under the agreement for out-of-pocket costs related to the breach, with up to $5,000 available for verified expenses that were most likely caused by the incident. Claimants must demonstrate that they took reasonable steps to reduce damages or secure recompense, and eligible losses must have happened between November 9, 2022, and May 11, 2026.

Customers who were residents of California at any time during that time may also be eligible for an extra $100 statutory payment; however, if claims surpass the settlement fund, that value may be lowered.

Any money left over after those payments are made will be given to class members in the form of a pro rata cash payment, which means that each person's final payout will be determined by the number of legitimate claims that are submitted.

May 11, 2026 is the deadline for filing a claim, while April 9, 2026 is the deadline for objecting to or opting out of the settlement.
